Last updated: October 22, 2025

This page summarizes the key provisions of the October Swimmer Application Services Agreement. For the complete contract language, read the Full Terms.

Acceptance of Terms

By installing or using any October Swimmer application, CLI tool, or service, you agree to the agreement linked above.

Services Overview

October Swimmer provides Salesforce applications (Lunasa, Apex Flame, Ro Backup, Batchforce, and Thunder), consulting services, and developer tooling (including the force, force-md, apexfmt, aer, ro, and batchforce CLI tools). Offerings run on, and depend on, the Salesforce platform.

Subscription & Renewal

  • Standard subscription term: 1 year unless otherwise noted.
  • Renewals occur automatically for successive one-year terms unless cancelled in writing at least 30 days before renewal.
  • Free trials last 7 days; continued use requires conversion to a paid subscription.

Usage Responsibilities

  • Follow Salesforce policies and platform usage rules.
  • Do not resell, redistribute, or misuse the services.
  • Keep account credentials secure; you are responsible for activity under your accounts.

Customer Data

  • Products run inside Salesforce. October Swimmer does not store your Salesforce data by default.
  • Support access to your org is optional and only used to investigate issues when you explicitly grant it.

Payments

  • Fees are billed in U.S. dollars and are non-refundable except as required by law.
  • Late or unpaid invoices may result in suspension of service.
  • Price changes are communicated at least 30 days before a renewal term.

Availability & Support

  • Services rely on Salesforce uptime. October Swimmer is not liable for Salesforce outages.
  • Planned maintenance windows may occur; notice is provided when possible.

Liability

  • Aggregate liability is capped at the fees you paid in the 12 months preceding the incident.
  • October Swimmer is not liable for indirect, incidental, or consequential damages.

Termination

  • Either party may terminate with 30 days written notice effective at the end of the current term.
  • Upon termination you must stop using subscription products; open-source tools remain governed by their licenses.
